Terms of Service

Welcome to Movyn. These Terms of Service ("Terms") govern your access to and use of the Movyn platform, including our website, mobile applications, and all related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Movyn Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms and policies referenced herein. If you do not agree to these Terms, you may not use the Platform.

Movyn reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms.

2. Eligibility

To use the Movyn Platform, you must:

  • Be at least 21 years of age (or 25 for certain vehicle categories)
  • Hold a valid driver's license issued in the United States or an accepted international equivalent
  • Maintain a clean driving record as determined by Movyn's screening criteria
  • Have the legal capacity to enter into a binding agreement
  • Not have been previously suspended or removed from the Platform

Movyn reserves the right to verify your identity, driving record, and eligibility at any time and to refuse or revoke access if eligibility requirements are not met.

3. Account Registration

You must create an account to access most features of the Platform. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your login credentials secure and confidential
  • Accept responsibility for all activity that occurs under your account
  • Notify Movyn immediately of any unauthorized use of your account

You may not transfer your account to another person or use another person's account without permission. Movyn may suspend or terminate accounts that violate these Terms.

4. The Movyn Platform

Movyn operates a peer-to-peer car sharing marketplace that connects vehicle owners ("Hosts") with individuals seeking to rent vehicles ("Guests"). Movyn is not a car rental company and does not own, operate, or control any vehicles listed on the Platform.

The Platform facilitates transactions between Hosts and Guests, including vehicle listings, booking management, payment processing, messaging, and dispute resolution. Movyn acts solely as an intermediary and is not a party to any rental agreement between Hosts and Guests.

5. Host Responsibilities

If you list a vehicle on Movyn as a Host, you agree to:

  • Provide accurate descriptions, photos, and availability for your vehicle
  • Maintain your vehicle in safe, clean, and roadworthy condition
  • Carry valid auto insurance that meets or exceeds state minimum requirements
  • Ensure your vehicle passes applicable safety and emissions inspections
  • Comply with all applicable laws, regulations, and local ordinances
  • Respond promptly to booking requests and Guest communications
  • Deliver the vehicle at the agreed-upon time and location
  • Report any incidents, accidents, or damage promptly to Movyn

6. Guest Responsibilities

If you rent a vehicle through Movyn as a Guest, you agree to:

  • Use the vehicle only for lawful purposes and in accordance with the rental agreement
  • Return the vehicle on time, in the same condition as received, and with the agreed fuel level
  • Not exceed any mileage limits specified in the listing
  • Not allow unauthorized drivers to operate the vehicle
  • Not use the vehicle for commercial purposes, racing, or off-road driving (unless explicitly permitted)
  • Report any accidents, damage, or mechanical issues immediately to both the Host and Movyn
  • Comply with all traffic laws and pay any fines or tolls incurred during the rental period
  • Not smoke in the vehicle unless the listing explicitly permits it

7. Bookings and Payments

All bookings made through the Platform are subject to the following terms:

  • Pricing: Hosts set their own daily rates. Additional fees may include service fees, protection plan costs, delivery fees, and mileage overage charges.
  • Payment: Guests are charged at the time of booking confirmation. Payments are processed securely through our third-party payment processor. Movyn holds funds and releases payment to Hosts within 3 business days after the trip ends.
  • Service Fee: Movyn charges Guests a service fee (typically 10-15% of the trip subtotal) to support Platform operations, customer support, and 24/7 roadside assistance.
  • Cancellation: Cancellation policies vary. Free cancellation is available up to 24 hours before the trip start time. Late cancellations may result in partial or no refund depending on the Host's cancellation policy.
  • Disputes: Any payment disputes must be raised within 72 hours of the trip's conclusion. Movyn will mediate disputes in good faith but is not liable for losses resulting from transactions between Hosts and Guests.

8. Insurance and Protection

Movyn offers protection plans to provide coverage during trips booked through the Platform. Protection plans are not traditional insurance policies but supplemental coverage programs administered in partnership with licensed insurance providers.

  • Basic Protection: Included with every booking. Provides liability coverage up to the state minimum with a $2,500 deductible.
  • Standard Protection: Comprehensive liability coverage with a $1,000 deductible, collision coverage, and enhanced roadside assistance.
  • Premium Protection: Full coverage with zero deductible, including comprehensive and collision, personal effects coverage, and priority support.

Protection plans are subject to exclusions and limitations as detailed in the Protection Plan Agreement provided at the time of booking.

9. Prohibited Activities

You agree not to engage in any of the following activities on or through the Platform:

  • Providing false, misleading, or fraudulent information
  • Circumventing the Platform to arrange transactions directly with other users
  • Manipulating ratings, reviews, or search results
  • Harassing, threatening, or discriminating against other users
  • Using the Platform to facilitate any illegal activity
  • Attempting to gain unauthorized access to the Platform or other users' accounts
  • Using automated tools, bots, or scrapers to access the Platform
  • Reverse engineering, decompiling, or disassembling any part of the Platform
  • Interfering with the proper operation of the Platform

10. Intellectual Property

The Movyn name, logo, trademarks, and all content on the Platform (including text, graphics, images, software, and design elements) are the property of Movyn, Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any Platform content without prior written consent from Movyn. User-generated content (such as vehicle listings, reviews, and photos) remains the property of the respective user, but by posting content on the Platform, you grant Movyn a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Platform.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOVYN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Vehicle damage, theft, or mechanical failure
  • Personal injury or property damage during a trip
  • Actions or omissions of Hosts, Guests, or third parties
  • Service interruptions or Platform unavailability

MOVYN'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MOVYN IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Movyn, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any vehicle listing you create or booking you make

13. Dispute Resolution

Any dispute arising from these Terms or your use of the Platform shall first be addressed through Movyn's internal dispute resolution process. If the dispute cannot be resolved informally, it shall be settled through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.

YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS ARBITRATION. All disputes shall be resolved on an individual basis.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

14. Termination

You may terminate your account at any time by contacting Movyn support or through your account settings. Movyn may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including indemnification, limitation of liability, and dispute resolution) shall survive.
